FC Sion files criminal complaint against FIFA

SION, Switzerland - FC Sion says it has filed a criminal complaint against members of FIFA's executive committee over its threat to suspend Switzerland from world soccer

Sion said on its website Thursday that the threat made on Dec. 17 by soccer's ruling body amounts to unacceptable blackmail and a breach of basic legal rules.

FIFA said it wanted the Swiss national association to discipline Sion within one month over a long-running legal battle.

Sion is contesting its expulsion from the Europa League in September for fielding players signed during a FIFA transfer ban imposed in 2009.

If the suspension takes effect, FC Basel would be prevented from playing Bayern Munich in the Champions League round of 16. The first leg is scheduled Feb. 22.

Is Nicole Scherzinger Leaving The X Factor?


Acknowledging a few mistakes made on the first season of The X Factor - too much judge bickering, overly involved production numbers - Simon Cowell told People Magazine this week he'll evaluate all aspect of the show for season two and that 2012 will be a "bloodbath."

We assume the producer was talking about the on-air competition, but might he also have been referring to backstage changes on the way?

With rumors that Steve Jones won't be asked back as host, Nicole Scherzinger recently laid the groundwork for her departure, as well.

“Next year for me, it’s about my music,” the singer told Radar Online. “This has been quite a learning experience, quite a journey for me. I didn’t expect to have been so emotional through the whole elimination process. I wanted to just mentor and empower artists.”

Scherzinger said she had planned to release an album in 2011, but her judging gig was too "time consuming."

Mark Zuckerberg vacations in Facebook-blocked Vietnam

For the holidays, Mark Zuckerberg went where Facebook is not allowed to go: Vietnam.

The Facebook founder vacationed in the communist state, arriving sometime around Dec. 22. Zuckerberg sitings almost immediately began to ricochet around the Web.

VnExpress reported that Zuckerberg was granted a two-week tourist visa to Vietnam on Dec. 16.

He and girlfriend, Priscilla Chan, visited the "Hanoi Hilton" prison in Hanoi on Thursday, according to local news websites.

The Dan Tri website quoted Tran Ngoc Bich, a tour guide at the prison, reporting that Zuckerberg and Chan joined a group of about 10 tourists who were "also very excited at seeing this talented young man."

A report on the VnExpress news website claimed Zuckerberg visited a shop that sells mobile phones on Thursday afternoon, but that his bodyguards would not let fans take photos with him.

The happy couple spent Christmas Eve in Ha Long Bay, local official Trinh Dang Thanh told Associated Press. And Christmas Day they spent at an ecolodge in the northern mountain town of Sapa.

Zuckerberg rode a buffalo there, reported Le Phuc Thien, deputy manager at Topas Ecolodge. Presumably the buffalo had a gentler fate than the bison who had the misfortune of encountering Zuckerberg.

Vietnam blocks access to Facebook and other websites. But young people in Vietnam bypass censors to use the service.

Facebook does have a representative in Vietnam who told one news outlet that he had not been informed about Zuckerberg's visit.

Website says Sinead O'Connor's marriage is over (AP)

LONDON ? A statement on Sinead O'Connor's website says her brief marriage to therapist Barry Herridge has ended amicably.

The statement on sineadoconnor.com says "the marriage was 16 days. We lived together for 7 days only.. Until Xmas eve."

The statement says "from the moment myself and my husband got together ... there was intense pressure placed upon him by certain people in his life, not to be involved with me."

She adds: "As my good friend said `well, at least you got married in Vegas in a pink Cadillac! Can't get more Rock n Roll than that.'"

Roman Szendrey, who maintains the site, told The Associated Press by phone Wednesday the report is accurate and was personally posted by O'Connor.

New York Times email misfire sets off firestorm (Reuters)

(Reuters) ? A New York Times employee misfired an email offering discounted subscriptions to customers who had recently cancelled the newspaper, sending it to more than 8 million people instead of the 300 intended recipients.

Questions about the emails hit Twitter on Wednesday, but it took the newspaper several hours to figure out what happened.

Initially the newspaper said it had not sent out those emails.

"The email is spam and was not sent from The New York Times," company spokeswoman Danielle Rhoades Ha had told Reuters.

She later apologized for the mix-up: "We regret this error and we regret our earlier communication noting that this email was spam."

The incident spawned a parody Twitter account, NYTSpam. "Ci@ali$, anyone? I'm tired of trying to sell papers," it said in one of its early Tweets.

Fire Emblem To Set Japan Ablaze Next Spring

Last night, Nintendo held the second of its Nintendo Direct online press conferences. In it, the Kyoto-based game creator confirmed several Japanese release dates. One of them was new ? the one for Fire Emblem.

While Nintendo did confirm Japanese release dates for titles like Metal Gear Solid: Snake Eater 3D (Mar. 8, which we knew), it also gave new release dates for Shin Sangoku Musou Vs., or rather Dynasty Warriors Musou Vs. (Mar. 15, which we didn?t).

Kingdom Hearts 3D: Dream, Drop Distance, once again, was given a wide release window. Once again, March was penciled in for its Japanese release ? just as it was earlier this month.

The one game that stood out was the eagerly awaited Fire Emblem 3DS title. That game will be out Apr. 19 in Japan. Yesterday, news broke that Fire Emblem will be the first 3DS game to have DLC for sale. According to the Nikkei report, Nintendo will begin moving forward with DLC in March, making it appear as though the game was dated for that same month.

Fire Emblem will be out on the 3DS in April ? the 19th to be exact.

Microsoft Windows Phone Marketplace Hits 50K Apps Milestone

It's been hardly 14 months since the launch of Windows Phone Marketplace and it has reached a new milestone in terms of number of apps available.

Windows Phone marketplace, which can also be termed as Redmond's answer to Apple's App Store and Google's Android Market, has over 50,000 apps and games on offer as of now.

The statistical fact was first revealed by a post in the All About Windows Phone blog. According to the blog post, more than one-third of the present 50,000 plus were added in the last 3 months alone, whereas near about 16 per cent made their way to the Marketplace within the last month.

In reality, however, users had access to far less number of apps compared to the 50K apps being reported by the statistics. This is because Microsoft removed somewhere around 6000 apps from the store over time bringing the total count to 42,655 apps.

Keeping in mind how Apple and Google are far ahead in the game with their App Store and Android Market, it would take Microsoft a long time and some heavy marketing before it catches up with them.

Dearborn woman dies on way to sister's wedding

Dearborn ? Eitedal Sufian Al-Gaithi was looking forward to attending and being a part of her older sister Noha's wedding on Christmas Day.

It is the custom in her native country of Yemen that everybody in the family participates in the wedding.

But she never made it.

She was killed in a car accident en route to Greenfield Manor, where the wedding was to take place.

"We hadn't even made it inside the hall, and instead of celebrating one daughter's wedding, we're mourning the death of another daughter," said her father, Sufian Al-Gaithi, 40, of Dearborn, who has three other daughters and two sons. Eitedal would have turned 23 on Jan. 23.

She had big dreams, and wanted her husband, Fattah, to share them. But Fattah remained in Bahrain while, her father said, she worked tirelessly trying to bring him to America.

"She was supposed to surprise him by flying there on Wednesday," Al-Gaithi said.

"Now we're trying to get the U.S. Embassy in Bahrain to allow him to come here to see her before she is buried."

Eitedal also cared for others at home.

"She lived with my parents and took care of them because they're both diabetic," said her father. "It is such a big loss for them also. We were afraid to tell them what happened for fear they might both have heart attacks and die themselves."

Al-Gaithi said his daughter was attending nursing school.

Al-Gaithi said his niece, Eiman Alammare, 21, who also was in the car, remains in critical condition in intensive care at Oakwood Hospital.

Eitedal Al-Gaithi and Alammare were ejected from a 2009 Jeep driven by a 20-year-old Dearborn man, Dearborn Police Sgt. Doug Topolski said.

"We're still trying to sort this all out, but it appears they were all northbound on Greenfield about 6:30 p.m. when the Jeep struck a 2008 Chevy Cobalt turning into the Manor, where they were also headed," Topolski said.

"The Jeep spun around and struck a building," he said. "Both of the victims were sitting in the rear seat and were ejected out the passenger door."

The Jeep's driver, a 19-year-old Dearborn woman driving the Cobalt and her two passengers were all treated for minor injuries and released, he said.

Fabolous Will 'Evolve' On Loso's Way 2

Now that Fabolous has killed off his competition with Christmas mixtape There Is No Competition 3: Death Comes in 3s, the Brooklyn MC is fast at work on his sixth studio album, Loso's Way 2.

"Loso's Way 2 is a work-in-process. I put a lot in my mixtapes, but I definitely put a lot into my albums as well," Fab told MTV News, referencing the DJ Drama-helmed TINC 3 and the upcoming album. "I know a lot of people like mixtape Fab, and albums, to me, you're speaking to a broader audience sometimes. I take that at hand. I guess everybody doesn't see that."

Since his rise in the late 1990s on DJ Clue's street mixtapes, Fab has carved a niche as a witty lyricist, thanks to his clever punch lines and lyrics. It's a style that he expertly employs on each of his mixtapes, but when the "Make Me Better" MC gets into album mode, he has a different focus.

"With the album, I'm looking to evolve as well. Musically, everything I do, I want to keep growing," he said. "I think people have seen my growth album to album. From Ghetto Fabolous to Street Dreams to Real Talk to From Nothin' to Somethin' to Loso's Way, and now they will continue to see that with Loso's Way 2."

It wasn't that Fab lacked substance in any of his previous works. On each of his LPs he included a vast array of topics, packaging party anthems, love songs and story rhymes. But while many of the top MCs like Eminem, Kanye West and at times Jay-Z began to open up about their personal lives, the largely private Loso remained so.

Fab began to change things in 2009 when he released Loso's Way. The #1 LP was anchored by Fabolous-style radio hits like "Throw It in the Bag" and "Everything, Everyday, Everywhere," but the nimble-tongued MC also exhibited welcome artistic growth when he rapped about his love for his son Johan on the Marsha Ambrosius-assisted "Stay."

"It's all a process for me; I'm in a different place," he said. "My last album I was having my first son and now my son is almost four years old, so these are processes and you get to talk about those things. I will share them on the next album."

Since releasing "Stay," Fab has seen much more of his personal life spill out into reality shows and the tabloids. His son's mother, Emily Bustamante, is a star on VH1's "Love & Hip Hop" and has been sharing tidbits of her and Fab's relationship on the show. The rapper is not a fan. "It's just not my cup of tea," Fabolous told New York radio host Angie Martinez on her Hot 97 show earlier this month. "It's one side of what's going on. I don't bash it, but I'm not really in support of it, either. I don't think it depicts me the way I am. It just depicts a one-sided version of what's going on."

Fab's feelings about the show won't deter him from opening up on Loso's Way 2. "Children change a lot of stuff in your life," he said to MTV News. "They change the way you look at things and do things. And I think the music will reflect that, too."

Japanese designer of arty kichenware Yanagi dies (AP)

TOKYO ? Sori Yanagi, whose designs for stools and kitchen pots brought the simplicity and purity of Japanese decor into the everyday, has died. He was 96.

The pioneer of Japan's industrial design died of pneumonia in a Tokyo hospital Sunday, Koichi Fujita of Yanagi Design Office said Monday.

Yanagi's curvaceous "butterfly stool," evocative of a Japanese shrine gate, won an award at La Triennale di Milano in 1957 and helped elevate him to international stature.

The work later joined the permanent collection of the Museum of Modern Art in New York and the Louvre museum in Paris.

Another typical Yanagi design was the stackable plastic stool, humorously called the "elephant stool," because of its resemblance to the animal's chunky feet.

The lines and curves of Yanagi designs were as distinctly Japanese as they were universal, winning him fans ? and a place in homes not only in Japan but around the world ? for his tea pots, ceramic cups and even the lowly whisk, which became artwork with his touch.

Yanagi chose design for his career after falling in love with the work of architect Le Corbusier while studying at a Tokyo fine art university.

Credited with paving the way on the international stage for younger Japanese designers, Yanagi also took up more monumental pieces, such as bridges and the Olympic torch, as well as a motorcycle and toys.

He supported Japanese traditional art throughout his life, and he served as head of the Japan Folk Crafts Museum in Tokyo, which his philosopher father founded.

Funeral arrangements were not being disclosed as the ceremony is for family and close friends. He is survived by his wife Fumiko and four children, Fujita said.

    Mexico police arrested over torture video (Reuters)

    MEXICO CITY (Reuters) ? Mexican authorities arrested five policemen on Monday on suspicion of torture after a video was made public showing police officers submerging a detainee's head in a bucket of water.

    An official at the attorney general's office said five Mexico City police officers were taken into custody over the alleged torture, which took place in the capital's tough inner city neighborhood of Tepito last month.

    Soon after the incident, a video was posted on the Internet showing a man with his shirt pulled over his head being dunked in a bucket of water while in the custody of a unit of well-armed policemen. (http://www.youtube.com/watch?v=spQi5-e4ft4 )

    President Felipe Calderon's term in office has been dominated by an army-led crackdown on drug trafficking cartels, which sparked a wave of criminal violence that has claimed more than 45,000 lives in the past five years.

    Human rights groups have accused the police and army of abuses, including torture and killings, though very few officials have been convicted. Last month activists asked the International Criminal Court in The Hague to investigate Calderon and top officials over the allegations.

    Denver coach Joe Scott building a better basketball program

    Scott tapping into Denver's basketball history with an eye on fans and winning.

    The more Joe Scott learns about the University of Denver's distant basketball past, the more driven he becomes for what he wants to see in the future.

    On a trip to Utah State in November ? a 67-54 Denver victory ? Scott discovered there's some DU history to build on. The Pioneers have the fourth-longest series on Utah State's schedule. They met for the first time in the 1922-23 season, but they have met just twice since 1978.

    Then Monday, the Pioneers played their 148th game in the series with Wyoming. There's Division I men's basketball history at DU, but it needs a dusting.

    Scott, who was hired at DU in March 2007 after coaching stops at Air Force and Princeton, hopes to build the Pioneers program into a consistent contender for postseason play. However, they are postseason poor.

    In the early years, DU made appearances in the Regional AAU Tournament, and there were appearances in the NAIA and NCAA Division II tournaments, but the only postseason appearance in Division I was in 2004-05, when the Pioneers took a 20-10 record into the National Invitation Tournament.

    Scott's fifth Pioneer team seems headed in the postseason direction. At 10-2, it has established itself as one of the program's best ever.

    "Denver's known as a sleeping college basketball town," Scott said. "Maybe if we can keep our season going, the people here who like college basketball will show they're not sleeping anymore."

    If the Pioneers defeat Troy in their Sun Belt Conference opener Thursday night at Magness Arena, going 11-2 would equal DU's best start in Division I, set in 1942-43.

    Scott has put together an interesting mix of players he hopes will continue the program's rise. There's veteran leadership with forward Rob Lewis, guard Brian Stafford and brothers Chase and Travis Hallam. But maybe the most exciting parts of the team are the younger players headed by sophomore Chris Udofia, who has established himself as one of the best college players in the area. Udofia (13.9 points per game) and Stafford (14.1) are in a close battle for the team scoring lead.

    Guard Brett Olson, out of Highlands Ranch High School, is starting as a freshman. Senior forward Justin Coughlin, sophomore forward Blake Foeman and freshman forward Royce O'Neale are providing effective play off the bench.

    Scott often credits his players with accepting and fulfilling their roles.

    The coach also has accepted a role, albeit risky for coaching tenure, in building the Pioneers' basketball image. He put some gusto into the nonconference schedule by playing perennial postseason contenders St. Mary's, California, Iona and Utah State along with continued rivalries with Wyoming, Northern Colorado and Colorado State.

    "Our nonconference schedule has gotten more difficult every year," junior guard Chase Hallam said. "It has made us a better team. If you play well against the better teams, it builds confidence."

    Scott sees a beneficial circle.

    "People are smart, they know when you're a good team," Scott said. "They know if you're playing good teams. The more you play good and you play good teams, the more college basketball fans you find. They're just waiting to be turned on here."

    More than 7,000 fans turned out for the Wyoming game.

    "I grew up watching rivalry games," Scott said, pointing to his roots in New Jersey. "I watched Providence and Holy Cross, Princeton and Rutgers. Those are huge rivalry games. The schools are older on the East Coast, and there's a lot of college basketball tradition."

    Scott isn't a novice at building a program. Eight years ago, his fourth Air Force team went 22-7 and won the Mountain West Conference regular season at 12-2 to advance to the 2004 NCAA Tournament for the first time since 1962. That was the Falcons' first winning season since going 15-10 in 1977-78.

    "I'd like to bring Notre Dame to play us in Magness Arena," Scott said of future goals. "I'd go there twice if we could get them to come here once."

    Why Microsoft wants to kill netbooks?


    Last week one of the major business-oriented computer manufacturers, Dell announced that it would no longer produce netbooks. The company will be still selling a couple of Latitude business models, but it's not going to develop new netbooks on the upcoming Intel Cedar Trail platform. Obviously, Dell was not happy with netbook sales. And other netbook manufacturers are also having problems. According to ABI Research, netbook sales in Q2 of this year fell to 7.3 million from 13.6 million in the Q1. At the same time, the sales of the competing technology - tablets during the same period grew from 6.4 million to 8.4 million. But tablets aren't the main reason of the netbooks problem. The main reason is Microsoft.

    Microsoft didn't like netbooks from the very beginning. Because the idea of netbook is "Cheap, small, low-power laptop for working in the Internet". The Windows operating system appeared to be excessive for netbooks. Everything was ok with Windows XP, but Vista for the device in which the main application - it browser, was not good at all. And the market price of netbooks ($200-300) can't include $100 for Windows license. Microsoft had to sell Windows licenses to OEMs with big discount. And it's losing money each time when a customer chose a cheap netbook instead of a full-featured laptop.

    In Windows 7 Microsoft introduced a number of limitations. First, the stripped version of the OS for netbooks Windows 7 Starter could only be installed on netbooks with smaller than 10.1 inch screen and less than 1GB of memory. Second, Windows 7 Starter lacks some important for business features - Windows Server support, encryption, support for workgroups. While business users - are probably the main buyers of netbooks.

    As a result, there almost no good Windows-netbooks on the market. But buyers still want the cheap Windows-netbooks.

    Another case with tablets. They cost from $600 and people buy them mostly because of apps, but not because of browser. This niche is more interesting for Microsoft. That's why the new Windows 8 is positioned as an OS for tablets.

    The last hope for netbooks - is Google, with its Chromebooks and Chinese manufacturers, that love to produce cheap devices.

    Suicide attacker kills 7 at Baghdad checkpoint (AP)

    BAGHDAD ? A suicide bomber set off a car bomb Monday at a checkpoint leading to the Iraqi Interior Ministry, killing seven people and injuring 32 others, officials said.

    The attack followed a series of bombings last week that killed up to 70 people in a single day, increasing fears about Iraq's future after U.S. troops withdrew this month.

    Two police officers said the bomber struck during morning rush hour, hitting one of many security barriers set up around the ministry's building. Five policemen were among the dead, they said.

    Two doctors at nearby hospitals confirmed the causality figures. All spoke on condition of anonymity because they were not authorized to release information.

    No one has claimed responsibility, but suicide attacks are the hallmark of the al-Qaida in Iraq terror group.

    U.S. and some Iraqi officials have warned of a resurgence of Sunni and Shiite militants and an increase in violence after the full U.S. troop withdrawal.

    Adding to Iraq's troubles is an increase in political tension stemming from a showdown between the Shiite prime minister, Nouri al-Maliki, and the top Sunni political leader in the country.

    Al-Maliki's government has issued an arrest warrant for Sunni Vice President Tariq al-Hashemi on charges that he ran hit squads against government officials.

    Al-Hashemi has denied the charges and said they are politically motivated.

    U.S. economy hopes give European stocks respite (Reuters)

    LONDON (Reuters) ? Signs of renewed momentum in the giant U.S. economy boosted European stocks and supported the euro on Friday, but any gains in holiday-thinned markets are likely to prove short-lived with concerns about the euro zone debt crisis undiminished.

    "There's no doubt that events in the euro area in the first quarter of next year... have the potential to have a profound impact across the globe," said Chris Scicluna, an economist at Daiwa Capital Markets.

    The single currency edged up 0.1 percent to $1.3065, holding above a recent 11-month low of $1.2945, although it remains down around 2.1 percent on the year.

    "The dollar is still seen as a funding currency when risk appetite improves and people will sell dollars on the back of that," said Chris Walker, currency strategist at UBS.

    "But we still see uncertainties in the euro zone outweighing and look for a move towards $1.25 in the next few months," he added.

    The United States reported the lowest level of weekly jobless claims since April 2008 on Thursday, as well as a rise in the Thomson Reuters/University of Michigan's consumer sentiment index.

    "This improved set of data we've had through Q4 in the U.S. is at least something to be encouraged about," said Daiwa's Scicluna.

    MSCI's world equity index gained around 0.3 percent since the data was published (.MIWD00000PUS), but remains on track for a fall of about 12 percent in 2011.

    The pan-European FTSEurofirst 300 index gained around 0.5 percent.

    ECB FUNDS SOOTHE

    The European Central Bank's mid-week provision of 490 billion euros of cheap longer-term cash to over 500 of the region's banks - the largest ever amount of liquidity pumped into the financial system - is expected to support debt markets.

    The loans are expected to ease the impact of a wave of capital outflows of U.S. money market funds from European banks that has gummed up the interbank market, and should also support bank shares.

    Outgoing ECB executive board member Lorenzo Bini Smaghi also suggested in comments in the Financial Times on Friday that the ECB could give in and adopt "quantitative easing" to boost the euro zone economy if deflation risks emerge across the 17-country region.

    His comments are the strongest indication yet that the central bank could expand its policy tools to prevent a possibly disastrous economic slump in continental Europe, although Bini Smaghi himself steps down at the end of December.

    Meanwhile, fellow ECB Executive Board member Juergen Stark, who also steps down at the end of the month, was quoted as saying that Europe should not use the International Monetary Fund to get around the ban on central banks financing governments and that current plans might breach that principle.

    "Practically, I don't see any countries other than euro zone states that want access to the money. It is an attempt to circumvent the ban on direct monetary financing in Europe," Stark told German daily Die Welt in an interview.

    Yields on Italian 10-year bonds were 4 basis points higher at 6.97 percent, back within a whisker of the 7 percent mark seen as unsustainably high over the long-term, with the Spanish equivalent little changed at 5.42 percent.

    Unsurprisingly, in 2011 Italian bonds (.QW4AP) have been one of the worst performers, posting losses of 5.65 percent overall with longer-dated paper losing almost 11 percent (.QW4U).

    The rosier picture painted by the U.S. data is also supporting commodities, with copper, which is sensitive to expectations of industrial demand, rising 1.0 percent to $7,615 a tonne, on course for its first weekly gain in three weeks.

    Tax cut survives: Congress votes holiday approval (AP)

    WASHINGTON ? Barely beating Santa's sleigh, Congress delivered a last-minute holiday tax-cut extension to 160 million American wage-earners on Friday, just when it looked like they and millions of unemployed workers were going to be left with coal in their stockings.

    It was a major yearend political victory for President Barack Obama, a big slice of humble pie for House Republicans and a blow to House Speaker John Boehner, R-Ohio, who'll have an angry band of tea party lawmakers to deal with when Congress returns to Washington next month.

    Back-to-back voice vote approvals of the two-month special measure by the Senate and House came in mere seconds with no debate, just days after House Republican leaders had insisted that reopening negotiations on a full-year bill was the only way to persuade them to prevent a tax increase on Jan. 1.

    Obama immediately signed the bill into law.

    "I said it was critical for Congress not to go home without preventing a tax increase on 160 million working Americans and I'm pleased to say that they got it done," a buoyant looking Obama said at the White House before dashing off for his delayed holiday vacation to his home state of Hawaii.

    Actually most lawmakers were long gone. A token few showed up to make approval official.

    The legislation buys time for talks early next year on how to finance the year-long extensions ? negotiations that promise to be contentious, especially if Democrats continue to use Obama's jobs agenda to seek a political edge in the 2012 presidential and congressional campaigns.

    The measure will keep in place a 2 percentage point cut in the Social Security payroll tax ? worth about $20 a week for a typical worker making $50,000 a year ? and prevent almost 2 million unemployed people from losing jobless benefits averaging $300 a week. Doctors will win a reprieve from a 27 percent cut in their Medicare payments, the product of a 1997 cut that Congress has been unable to permanently fix.

    Republicans did claim a major victory, winning a provision that would require Obama to make a swift decision on whether to approve construction of the Canada-to-Texas Keystone XL oil pipeline, which could generate thousands of construction jobs. To stop construction, Obama, who had wanted to put the decision off until after the 2012 election, would have to declare it was not in the nation's interest.

    On Friday, an expressionless Boehner read from a piece of paper before him, gaveled the House's last session of the year closed and stepped off the podium on the Democratic side.

    Boehner had been open to the Senate's version of the legislation a week ago, even though it would have punted the issue into February and given Democrats a proven political issue. But tea party forces and some in his own leadership revolted, insisting on picking a holiday fight with Democrats, and Boehner felt no choice but to go along.

    The battle turned out to be a loser for House Republicans, earning the ire of swing voters and many in the GOP establishment, but when Boehner capitulated on Thursday he then felt the lash from hard-core conservatives.

    "Even though there is plenty of evidence this is a bad deal for America ... the House has caved yet again to the president and Senate Democrats," said Rep. Tim Huelskamp, R-Kan.

    Meanwhile, Democratic Senate leader Harry Reid of Nevada did a victory lap, twisting the knife into tea party Republicans.

    "I hope this Congress has had a very good learning experience, especially those who are newer to this body," Reid said. "Everything we do around here does not have to wind up in a fight."

    A full-year extension of the tax cut had been embraced by virtually every lawmaker in both the House and Senate but had been derailed in a quarrel over demands by House Republicans. Senate leaders of both parties had tried to barter their own yearlong agreement a week ago but failed, instead agreeing upon a 60-day measure to buy time for talks next year.

    House GOP arguments about the legislative process and what the "uncertainty" of a two-month extension would mean for businesses seemed lame to many people when compared to the consequences of raising taxes and cutting off jobless benefits in the middle of the holiday season, and Obama and the Democrats were hard on the offensive. House Republicans finally resorted to a technical fix and the fact that Reid would name negotiators on the GOP's yearlong measure as reasons to reverse course and embrace the Senate measure.

    Friday's House and Senate sessions were remarkable. Both chambers had essentially recessed for the year, but leaders in both parties orchestrated passage of the short-term agreement under debate rules that would allow any individual member of Congress to derail the pact, at least for a time. None did.

    The developments were a clear win for Obama. The payroll tax cut was the centerpiece of his three-month, campaign-style drive for jobs legislation that seems to have contributed to an uptick in his poll numbers ? and taken a toll on those of congressional Republicans.

    The two-month version's $33 billion cost will be covered by a 0.1 percentage point increase on guarantee fees on new home loans backed by mortgage giants Fannie Mae, Freddie Mac and Ginnie Mae ? at a likely cost of about $17 a month for a homeowner with a $200,000 mortgage.

    The top Senate Republican, Mitch McConnell of Kentucky, was a driving force behind the final agreement, imploring Boehner to accept the deal that McConnell and Reid had struck last week and passed with overwhelming support in both parties.

    Even though GOP leaders including House Majority Leader Eric Cantor, R-Va., promised that the two sides could quickly iron out their differences, the truth is that it will take intense talks to figure out both the spending cuts and fee increases required to finance the longer measure.

    Republicans want to shorten the maximum length of unemployment benefits from 99 to 79 weeks, freeze the pay of federal civilian workers and make federal workers contribute more into their pensions ? all ideas considered by the failed debt "supercommittee" this fall. The main provisions of the yearlong House measure cost about $200 billion, and the final version could cost more.

    Reid signaled a hard line for the House-Senate talks by assigning Sen. Ben Cardin, D-Md. ? a strong advocate for federal workers ? to the Democratic negotiating team.

    (AP) ? It will be a traditional Christmas weekend for Queen Elizabeth II's extended family, which now includes the former Kate Middleton, with the quiet holiday break to be followed by a year's worth of festivities to mark the queen's 60th year on the throne.

    Most of the senior royals, including Prince William and his wife, now formally known as the Duchess of Cambridge, will be dispatched across the globe to help the aging monarch celebrate her Diamond Jubilee in grand style.

    Elizabeth and her husband, Prince Philip, are planning to mark the event with a series of tours throughout England to culminate with a celebration in London in early June that will include an unprecedented pageant on the River Thames with up to 1000 boats taking part.

    In a carefully choreographed scenario, the flotilla will be led by the queen aboard the Royal Barge.

    "They're hoping the Diamond Jubilee will be as successful as the Golden Jubilee in 2002," said Joe Little, managing editor of Majesty magazine. "The media then thought the public wasn't interested, but by the big weekend there were 1 million people in the streets celebrating. I think that will happen again."

    He said the queen was surprised by the outpouring of affection in 2002.

    "Even after 60 years she is very self-effacing, and she's always amazed when people turn out to celebrate her achievements," he said. "You'd think by now she'd know how loved she is."

    The Diamond Jubilee will mean extra overseas travel for many royals: Prince Charles and his wife Camilla will jet off to Australia, Canada, New Zealand and Papua New Guinea; William and Kate will represent the queen in Malaysia, Singapore, the Solomon Islands and the tiny island of Tuvalu; while Prince Harry is being sent to the Caribbean to tour Belize, Jamaica and the Bahamas.

    The queen and Philip plan a series of trips throughout England, Scotland, Wales and Northern Ireland from late March to mid-July. She is then expected to help open the Olympic Games in July before beginning her summer holiday.

    With so many public events planned, it is not surprising that most of the Christmas festivities will be held in private at Sandringham, the queen's sprawling estate in rural Norfolk.

    Palace officials said Friday that the royals plan to attend a Christmas service at the Church of St. Mary Magdalene on the estate grounds. This gives well-wishers a chance to see the royals briefly, and also provides photographers a chance to snap pictures of the queen ? and Kate.

    The family traditionally exchanges gifts at Sandringham on Christmas Eve.

    After the church service, the royals usually walk on the grounds, have a gala lunch, and gather to watch the queen's prerecorded television broadcast, a tradition that began with a radio address by King George V in 1932.

    Americans frustrated by congressional stalemates (AP)

    CHICAGO ? As Americans watch yet another political drama play out on Capitol Hill ? this time over whether to extend the payroll tax cut and jobless benefits ? they have a question for Congress: Can't you all just get along? For once?

    "It's like, `Kids, kids, kids,'" said Brenda Bissett, a lawyer from Santa Clarita, Calif., as she waited for coffee Wednesday at a Starbuck's in downtown Los Angeles. "It's just frustrating that there's no compromise ... I do it all the time."

    Around the country, people of different backgrounds, incomes and political leanings say they're angry and downright disgusted by the posturing in Washington after the House rejected a two-month extension of the payroll tax cut passed by the Senate, then both chambers adjourned for the holidays.

    If lawmakers don't act by Jan. 1, payroll taxes will jump almost $20 a week, or $1,000 a year, for a worker earning $50,000, and as much as $82 a week, or $4,272 a year, for a household with two high-paid workers. What's more, about 6 million people could lose unemployment benefits, and Medicare payments to doctors would be slashed.

    "It's just another smack in our face for the working public. We just can't get ahead," said Mike Pryor, a construction worker from Aurora, Ill. "It seems like everything that Congress is doing is always against us ... I mean, I'm at a loss for words, and I just can't understand it, why they have to keep arguing."

    On Wednesday, President Barack Obama urged congressional leaders to return to Washington to pass a short-term payroll tax cut extension before New Year's Day, then work later on a full-year measure.

    Leaders from both chambers say they want the other side to return, too, though they still disagree on whether it should be to negotiate a two-month extension or a one-year deal favored by House Republicans.

    Meanwhile, the public can only wait and wonder ? and stew.

    At Augie & Ray's, a popular eatery in East Hartford, Conn., the consensus among several diners Wednesday was that the partisan bickering was eroding their already shaky faith in Congress. To some, that was just as frustrating as the idea that their paychecks could shrink.

    "It's us, the average Joe, that's getting caught in the middle," said Ray Ramsey, a retired utility meter technician who works part-time for a medical-supply company.

    Fellow diner Richard Longo, who owns a building-maintenance business, said he worries about the effect of the taxes on himself and his 30-plus employees. But he thinks there's a lot of blame to go around.

    "I truly believe that if the sides were reversed, if we had a Republican president and a Democratic Congress, we'd still be going through the same thing," he said.

    A payroll tax increase would come at a vulnerable time for some people who already have been affected by falling property values and, in some cases, state tax increases.

    Some expected to spend less on non-essential things, like dining out. And others said they were willing to pay more if it means reducing the deficit. But almost all agreed that the partisan acrimony and 11th-hour crises in Washington are getting old.

    "It seems they want to bring down everything to the last minute and then figure it out," said David Kaiser, an institutional researcher at Miami Dade College in Florida, who said a tax increase wouldn't affect him significantly.

    Kaiser wanted "some way to send that message to them: That's not what they're hired for."

    Mike Raney, a maintenance and repair worker from Chicago, said he blames the stalemate on "misguided ideals" among politicians of both parties.

    "I'd like to say they mean well, but we're talking about politicians," Raney said as he ate a hamburger at a McDonald's in Chicago's Loop. "It's very frustrating, especially for people who are just getting by. I mean, it's not like I'm making millions of dollars, but it's affecting other people a lot harder than it's affecting me."

    The tax cut lowered the Social Security tax on incomes of up to $106,800 from 6.2 percent to 4.2 percent. It's meant a maximum savings of $2,136 for an individual.

    Without a deal, Americans would begin 2012 facing a tax increase just as an election year begins. And many say the bickering has more to do with elections than economic ideals.

    "The way I see it is that the Republicans want Obama to be a one-term president," said James Edwards, an Amtrak conductor from Hamden, Conn., who was in Boston on Wednesday. "They are taking their patriotism and throwing it away, and they are hurting the middle class.     Anaiah Spencer, a property manager from Los Angeles, said the deadlock is damaging people's faith in lawmakers.

    "I have never seen a government this divisive," Spencer said. "In the end, we both end up broke, and we wind up with an entire country of angry citizens who don't know who to turn to."

    Greg Kirksey, a pastor in Little Rock, Ark., said a payroll tax increase would be little more than an inconvenience for him, but others are "talking about whether to buy dried beans or ground beef to get their protein."

    "But I'm afraid because it's a political year ... I'm not thinking anybody's really got the guts to make the hard decisions," he said. "They just keep putting a Band-Aid on, putting a Band-Aid on, kicking the can down the road a little farther."

    Buying Long Term Care Insurance

    As a follow up to my recent post about the high cost of elder care, I wanted to spend a bit of time talking about long term care (LTC) insurance. In general terms, LTC coverage applies to individuals who are not actually sick, but are not able to perform the basic ?activities of daily living,? which include bathing, using the bathroom, dressing, eating, and transferring yourself in/out of a bed, chair, etc.

    According to the Department of Health and Human Services, about 60% of those aged 65 or older will require some sort of long term care during their lifetime, with over 40% requiring care in a nursing home. And, for the most part, traditional health insurance and Medicare won?t cover the costs associated with this care. In other words, you?re on your own, so you?d be well advised to plan ahead.

    What follows is a list of important considerations when it comes to choosing a long term care policy. This list is by no means exhaustive ? it?s mainly based on things that I?ve run across while reading through my parents? policies ? but it at least gives you a good place to start.

    When to buy

    First and foremost, you?ll need to decide when to buy your policy. In general terms, if you buy too soon, you may wind up paying for coverage that you don?t need (yet). But if you wait too long, the premiums will be sky high. Also, the longer you wait, the more likely you?ll be rejected for coverage. For reference, more than half of all policies are sold to those in the 55-64 age group, though an argument could definitely be made for buying as early as age 45.

    Benefit level

    Another important consideration is how much coverage you?ll need. Obviously, more is better, but higher benefits come at increased cost. It really seems like this one falls into the ?it depends? category, as the costs associated with different types of care vary widely across the country. In other words, one size doesn?t fit all.

    Benefit increase option

    Related to the above? Costs associated with long term care will increase over time. Do you want your benefit level to increase, as well? In many cases, you can elect a ?benefit increase? option to help keep pace with inflation, though this will likewise come at a cost. Still, this is worth at least considering, especially if you buy a policy relatively early.

    Elimination (waiting) period

    The elimination period is a bit like a deductible, in that you?ll have to pay for the care yourself (out-of-pocket) for a set period of time before your LTC benefits kick in. Elimination periods can vary from 20-120 days, though 90 days seems fairly common. Note that you can typically only count those days on which costs were actually incurred, so you can?t just pay someone to come in once a week for 3 months to satisfy a 90-day elimination period.

    Waiver of premium

    Once the benefits kick in, do you need to keep paying the premium? In some cases, yes, in other cases, no. In my parents? case, the waiver of premium appears to only kick in after they?ve spent 60 days in a nursing home. In other words, it doesn?t appear to apply to in-home healthcare (though I?m still trying to track this down). This is a bit of a bummer, but it is what it is.

    Maximum lifetime benefit

    Finally, depending on the policy that you choose, there may be a maximum lifetime benefit. This limit can be defined either in terms of a total dollar amount, or a set number of years over which the policy will pay out. Choose carefully, as you may live longer than you expect, and these costs really add up over time.

    Study linking virus and chronic fatigue retracted

    (AP) ? The journal Science is retracting a controversial 2009 report that linked chronic fatigue syndrome to a virus.

    In an unusual move, Science is taking that step on its own. Normally, authors retract their own research papers when serious problems arise after publication.

    But Science has lost confidence in the report and the validity of its conclusions, editor-in-chief Bruce Alberts writes in Friday's issue. He said most of the authors have agreed in principle to retract the paper, "but they have been unable to agree on the wording of their statement." A retraction signed by all the authors "is unlikely to be forthcoming," Alberts wrote.

    The original paper, from scientists at the Whittemore Peterson Institute in Nevada and the National Cancer Institute, reported finding a virus called XMRV in blood cells of patients with chronic fatigue syndrome. That raised hope that a cause of the mysterious illness had been found.

    But follow-up studies by other scientists found no evidence of such a link. Last May, Science published two reports suggesting the original finding was due to lab contamination.

    At the time, Alberts published a statement declaring that the validity of the study was "now seriously in question."

    Then in September, the authors retracted some of the data, citing contamination.

    In his statement on the full retraction, Alberts said the authors had also acknowledged omitting important information about the study's procedures in an illustration of some lab results.

    Robert Silverman of the Cleveland Clinic, one of the paper's 13 authors, said in a statement Thursday that he was pleased by the full retraction. He said he had sought one this summer after finding that blood samples were contaminated.

    The Whittemore Peterson Institute is preparing a statement about the retraction, a spokeswoman said Thursday.
