Zynga, Facebook Alter Games Partnership - Business Insider

Zynga and Facebook have agreed to substantially change an agreement the two companies struck two years ago, a new SEC filing reveals.

That agreement gave Zynga a privileged position on Facebook's platform.

The revision appears to make Zynga more subject to Facebook's general terms for app developers. Effective in March, Facebook will be free to develop its own games, and won't have to deliver on certain measures of growth for Zynga.

Zynga also won't have to use Facebook ad units or Facebook's payments system on its non-Facebook game websites.

Zynga, whose stock has cratered as its games on Facebook have suffered a drop in usage and monetization, has been trying to get away from its dependence on Facebook and emphasize its mobile games, while Facebook has been quick to point out that other game developers using its platform are doing better than Zynga.

That said, Zynga has had two recent hit sequels in its key Facebook-game franchises, FarmVille and CityVille.

Here's the text of the filing:

Item 1.01 Entry into a Material Definitive Agreement
On November 28, 2012, Zynga Inc. (?Zynga?), Zynga Game Ireland Limited, Zynga Luxembourg S.?r.L., Facebook, Inc. (?Facebook?) and Facebook Ireland Limited entered into Amendment No. 3 to the Developer Addendum dated May 14, 2010 (?Addendum No. 1?) and Zynga, Zynga Game Ireland Limited, Facebook and Facebook Ireland Limited entered into Amendment No. 3 to the Developer Addendum No. 2 dated December 26, 2010 (?Addendum No. 2?). These amendments to the respective addenda, which supplement and amend Facebook?s standard terms of service for game developers, will apply through May 13, 2015, subject to earlier termination as noted below or in the agreements, as amended.
The material terms of these amendments are summarized below.
1. Amendment No. 3 to Addendum No. 1 (?Addendum No. 1 Amendment?).
Zynga?s use of the Facebook platform and any Facebook data on any Zynga service offered through a Zynga game page (e.g., Zynga.com) will be governed by Facebook?s standard terms of service, effective on March 31, 2013. Zynga will no longer be separately obligated to display Facebook ad units or implement Facebook credits on any such Zynga game pages. In addition, the Addendum No. 1 Amendment provides that Zynga?s right to cross-promote any games that are off of the Facebook web site from Zynga services that use Facebook data and to use e-mail addresses obtained from Facebook, will be limited by Facebook?s standard terms of service, subject to certain exceptions.
2. Amendment No. 3 to Addendum No. 2 (?Addendum No. 2 Amendment?).
The exclusivity provisions of Addendum No. 2 no longer require Zynga, subject to certain exceptions, to use Facebook as the exclusive social platform for the Zynga properties and to grant Facebook certain title exclusivities to Zynga games on the Facebook platform, except as provided below. The following provisions apply:
(a) Facebook?s existing non-discrimination obligations set forth in Addendum No. 2 will continue with respect to Zynga?s games on the Facebook web site.
(b) Any social game launched by Zynga will generally be available through the Facebook web site concurrent with, or shortly following, the time such game is made available on another social platform or a Zynga property. This requirement does not apply to any Zynga mobile games, social games owned and operated by a third party, any social games that cannot be launched on the Facebook web site due to technical limitations, any downloadable social games or any Zynga games launched in China or Japan.
(c) If Facebook allows real money gambling games on the Facebook web site in countries where Zynga has real money gambling games, Zynga will subsequently launch such games on the Facebook web site, if certain conditions are met by Facebook.
(d) If Zynga acquires any social game that was made available on a Zynga property but not on the Facebook web site prior to the acquisition, Zynga will enable and generally make available such game through the Facebook web site after the close of such acquisition.
In addition, effective on March 31, 2013, certain provisions related to web and mobile growth targets and schedules will no longer be applicable and Facebook will no longer be prohibited from developing its own games. Further, Zynga?s right to cross-promote between games on the Facebook web site will be governed by Facebook?s standard terms of service.

Skateboarding Trucks

What on earth are skateboarding trucks?

When I was growing up there was no such thing as a skateboard truck.

As a matter of fact, skateboarding and trucks didn't mix, it usually meant you were in trouble of being hurt.

Now though skateboards have become very sophisticated pieces of equipment and employ the use of a skateboard truck to connect the wooden deck to the wheels.

Let's take a look at the skateboard truck.

This is what a skateboard started with when I was young. It started with the old clamp on street skate.

To make the skateboard we would take a single skate apart in the middle separating the two wheel sections. this wasn't too difficult of process just a simple matter of unbolting them.

The toe clamp could also be disassembled.

The heal was a little more difficult. The heal rest at the very back of the skate at times had to cut off so you'd have a flat surface to bolt to piece of wood.

The picture below shows the finished product. Check out those metal wheels. They were noisy and didn't roll all that well.

Fast forward 60 years and I give you the modern skateboard trucks as presented in the above image.

These new trucks have built in dampers to cushion the shock of landings from airborne tricks and also to provide flexibility for turning the skateboard which was next to impossible on the 1950's version.

Skateboarding is now not only an extreme sport of aerobatics, jumps and tricks but for some people it is a mode of transportation as you can now buy a motorized board.

The following describes the parts of the typical skateboard truck.

1. The Baseplate - The baseplate is where the truck is attached to the skateboard deck. There are holes in the baseplate where bolts are inserted that go through corresponding holes in the deck. Some of the more specialized trucks have baseplates with a number of different holes that provide a variety of options on how the truck can be attached to the deck. Each different mounting position changes the feel of the skateboard to the rider.

2. Pivot Bushing - You will notice by looking at the photo that the hanger (#3) appears to be attached to the baseplate at the pivot bushing and through the kingpin. In actuality one part of the hanger is sitting in a hard rubber bushing called the pivot bushing. It is not physically attached at this point, but instead floats in this rubber bushing. This allows the deck to rotate from side to side.

3. Hanger - The hanger is the piece of metal that holds the axle and forms the leg that goes into the pivot bushing and attaches to the rear assembly with the kingpin. Most of the hangers and baseplates manufactured are molded metal. That is they are formed in molds with poured metal. There are another group of trucks which are called "precision trucks". These are formed out of a solid piece of metal kind of like being carved out of a single block of metal. The precision trucks are much more expensive than the molded trucks.

4. Axle - The axle is a metal rod that extends through the hanger. It will extend beyond the ends of the hanger, is threaded on the ends and has a nut attached. This is where the wheels are installed.

5. Kingpin - The kingpin is what connects the hanger to the baseplate . The kingpin is a bolt that extends up through the baseplate with a threaded nut on the end. Attached over the kingpin are two bushings (#6 & #7) with the hanger inserted between them and attached with the bolt and washers. These bushings and the tightness of the kingpin control the ease with which the skateboard turns. The tighter the kingpin and stiffer the bushings the harder it is to turn. The looser the kingpin and softer the bushings the easier to turn. However, if too soft or too loose the wheels will come in contact with the bottom of the deck in a situation called "wheel bite" and the skateboard will suddenly slow down possible causing the rider to fall.

6. & 7. Kingpin Bushings - as already discussed these bushing help determine the ease of turning the skateboard.

We rec?d a call yesterday by a lady that was interested in investing in real estate. When I asked her where she found us, she told me that it was by searching for foreclosures on line.

Apparently she had been looking for a Santa Clarita Foreclosure agent adept enough to handle her needs with regard to investing in real estate in the SCV. I told here that I?d do what I could help

She came into our offices today and talked about coming into some money left to her by her departed mother?s life insurance policy. I got some preliminary information out of the way ? like if she has a place to live now, who else will be participating in the viewing and offering, and what is her ultimate goal ? flipping, sustainable income, wealth?

She wants to do some buying and renting. She was looking for advice on that front. I started to explain the market then I asked what kind of tenants she desired. She looked at me with a puzzled look on her face, I then said, those that pay their rent in the form of cash or those that are a bit more ?documented? in their approach.

She explained that she was also looking as best re-sale as a possible option, so the area and the crime profile would be something she?d be interested in taking up with the Sheriff?s Department.

I got it and we covered some of the areas that seemed to fit her needs, talked about current rents and prospective spring time rental increases in the Santa Clarita Valley. We also talked about the advantages and disadvantages of hiring a Santa Clarita property management company to service her real estate. While I have mixed emotions about some of the choices you have when wanting to find local Santa Clarita property management, sometimes they are the best fit for investors.

Working out the number when it came to investing in the Foreclosures, that are not on the market for sale in the Santa Clarita Valley, was a key component with our meeting. Deducing where prices are currently and what the discounts are for most of the REO inventory that is entering the Santa Clarita foreclosure market.

Unpack the reindeer sweater, ?tis the holiday party season again.

After years forswearing year-end celebrations because of belt tightening, more companies are feeling festive enough to host holiday gatherings, according to several recent surveys.

Close to 83 percent of 100 human resources managers said their companies will host an event this year, including 10 percent who didn?t have a party last year because of the economy, according to preliminary results from the annual Challenger, Gray & Christmas, Inc., holiday party survey.

Don?t expect an extravaganza. Few companies are going back to the champagne and caviar affairs common before the recession.

Instead, they?re opting for more modest or original activities -- a potluck lunch, after-hours party at the office, or volunteering at a food bank followed by dinner at a local restaurant. ?There appears to be a move from the more traditional night out, with dinner and a dance band,? says Robert Hosking, executive director at Robert Half International?s OfficeTeam division, which conducts an annual office party survey. ?I think companies are becoming more creative with this, and allowing employees to come back with recommendations.?

Most people like holiday parties. At companies that hold parties, 79 percent of managers and 75 percent of employees say they enjoy them, according to OfficeTeam?s 2012 office holiday party survey.

But even if office parties turn you into Mr. Grinch, you can?t afford to skip them, says business etiquette expert Barbara Pachter. ?Think of it as a business opportunity,? she says, ?because the people you meet may be interviewing you in three or six months? for a new position or promotion.

If your company is throwing some kind of shindig this season, here?s the experts? advice for making the most of it:

Don?t talk shop. Conversations about work are OK, in moderation. Parties are a chance to get to know co-workers on a different level. ??You can talk about what people are doing for the holidays, what vacations they have coming up,? movies, plays, or sports you or your kids play, Pachter says. ?Then you have a common bond.? Three things Pachter recommends steering clear of: sex, politics and religion. And as hard as it can be, don?t gossip about co-workers. If you get stuck, ?You can listen, but don?t contribute.?

Mingle. Move beyond your usual circle of co-workers and introduce yourself to people you might not run into otherwise. ?It?s a great place to network with more senior people who could influence your career,? Hosking says.?

Leave the thigh-high dress and ripped jeans at home. Think business casual. If you think something?s too suggestive or casual, it probably is, Pachter says.

Look like you?re having fun, even if you?re not. Body language can reveal a lot about a person?s attitude. You might be there under duress, but you don?t need to show it. Frowning, crossing your arms or sitting at the table texting will?broadcast how much fun you?re not having, Pachter says. To boost your confidence talking to higher ups, practice a few ?power poses? before you go, suggests career coach Susan Joyce, in this blog post.

Don?t get plowed. If you?re not a party person, it?s easy to drink too much to make yourself feel more comfortable. Don?t.? A participant in one of the etiquette seminars Pachter teaches shared the story of a young man who got drunk at his company Christmas party, told off his boss and got fired on the spot. ?The next day he couldn?t understand why his badge didn?t work,? she says. If you do over-imbibe, accept any morning-after ribbing. ?It usually blows over,? Pachter says, ?but if you get defensive, they?ve found your vulnerability and it?ll tend to stick around.?

Take pictures, but ask before posting anything online. Despite years of warnings about the damage people can do to themselves and their friends by posting pictures of potentially compromising situations on Facebook or elsewhere, it still happens all the time, Pachter says. Always ask.

Brief your spouse. If you?re bringing a significant other, give them the 411 in advance on co-workers you work with that they should know.

Don?t cut out early. If it?s a dinner, stay through dessert. If there?s dancing, stick around for at least one song.? ?If everyone in your department is staying, you should stay awhile too,? Pachter says.

Congo rebels begin slow retreat from Masisi

GOMA, Congo (AP) ? Rebels believed to be backed by Rwanda began retreating from the territory they seized last week and pulled out of the region of Masisi, their military leader said Wednesday, in a sign that international pressure has stemmed the advance of the fighters.

Gen. Sultani Makenga, the military chief for the eight-month-old rebellion known as M23, said his fighters intend to abide by an ultimatum issued by neighboring nations that called for their withdrawal from Goma by Friday. He said he had ordered his fighters to retreat along the southeastern axis from Masisi to Goma, and they will then leave Goma via the northern route to Rutshuru.

But in Washington, State Department spokeswoman Victoria Nuland said the U.S. is waiting for M23 to act and that it is unclear if the rebels definitely plan to withdraw from Goma, a strategic city in eastern Congo's mineral-rich region.

"We do see some movement of M23 troops, but we can't tell whether this is preparatory to a withdrawal or whether it's just sort of a redeployment," she said. "But we are continuing to press and to urge those with influence to press as well."

She said the top U.S. diplomat for Africa, Johnnie Carson, met with Congolese President Joseph Kabila and Prime Minsiter Augustin Matata Ponyo on Wednesday, hopbing to press all parties to support the plan that would see the M23 withdraw from Goma before a longer-term resolution is reached.

M23's military commander made assurances that the rebels will complete a pullback.

"My soldiers began to retreat from Masisi yesterday. We will go via Goma and then after that we will retreat to 20 kilometers (12 miles) past Goma toward Rutshuru," Makenga told The Associated Press. "I think that by Friday we will be able to complete this."

The M23 rebel group is made up of hundreds of soldiers who deserted the Congolese army in April. Since then they have occupied numerous villages and towns in mineral-rich eastern Congo, culminating in the seizing of the crucial, provincial capital of Goma last week. Although they claim to be fighting because the Congolese government has not upheld their end of a March 23, 2009 peace deal, an in-depth report by the United Nations Group of Experts says that M23 is a Rwandan proxy fighting in order to control eastern Congo's lucrative mines.

Congo's government spokesman Lambert Mende, who is based in the country's capital over 1,600 kilometers (1,000 miles) to the west, confirmed that they had received reports of troops pulling out of Masisi.

"Yes, there are reports of movements (of their fighters out of Masisi) but we won't label it a retreat until it's over. They have played this game with us before, where they say they are moving and then find a reason not to," Mende said. "There will be no negotiations with Congo until they are 20 kilometers (12 miles) outside the Goma city limit."

A regional bloc representing nations in the Great Lakes region of Africa had issued a deadline calling for M23 to retreat no later than Friday to 20 kilometers (12 miles) outside of Goma. They issued their ultimatum from Kampala, the capital of neighboring Uganda.

In Goma, there was skepticism over the rebels' claim and confusion, after the leader of M23's political wing insisted that the fighters were not leaving the city of 1 million that is the economic heart of one of Congo's mineral-rich regions.

M23 Vice-Minister of the Interior Theophile Ruremesha told The Associated Press on Wednesday that Congolese President Joseph Kabila's government needs to meet their wide-ranging demands for them to leave the city. "Kabila has to meet our demands if we are to pull out," he said.

In Washington, U.S. Secretary of State Hillary Rodham Clinton met with African Union Chairwoman Nkosazana Dlamini-Zuma to discuss the situation in Congo.

"With regard to the M23 rebel group, there is only one way forward: they must meet their commitments under the Kampala accords to cease their attacks, withdraw from Goma and pull back to the July lines," Clinton told reporters on Wednesday. "Under the Kampala accords, President Kabila's government has agreed to hear and address the grievances of the M23 leaders and we call on leaders and governments from throughout the region to halt and prevent any support to the M23 from their territory."

But both Clinton and Zuma sidestepped the issue of Rwanda's support for the rebels. Asked why Rwanda is not being called out publicly, Zuma said: "Our approach to this matter is that is doesn't help us in finger pointing, we just need a solution. ... For us, what is important is to get a resolution to that problem and the rest will be taken care of because Rwanda is part of the Great Lakes," she said. "Rwanda was there (at the Kampala meeting). It supported the decision so for us, that is what is important."

Clinton ducked the question, adding: "I would fully support the chairperson's comments. We have consistently called on all parties, including Rwanda, to play a positive role in helping bring about a peaceful resolution to this conflict and that includes ending any and all support for M23. Any military assistance from anyone to the M23 is in violation of the UN arms embargo."

In Goma, while some fear the M23, a group which in only eight months has a record of carrying out executions and of forcing children into its ranks, other residents of this lakeside city are afraid of the undisciplined Congolese army that was pushed out of Goma by the rebels on Nov. 20. Dozens of people came out for an anti-Kabila rally.

"I want Kabila to leave because he hasn't helped the people and our country hasn't moved forward since he came to power," said one of the marchers, Augustin Katombo. "I think M23 should stay because we don't want the army to come back."

About 1,500 U.N. peacekeepers were in Goma when M23 attacked on Nov. 20 and government forces fled, but the well-armed U.N. peacekeepers did not intervene, saying they lacked the mandate to do so. One of their main missions is to protect civilians.

A U.N. group of experts said in a detailed report last week that M23 is backed by neighboring Rwanda, which has provided them with battalions of fighters and sophisticated arms, like night vision goggles.

A similar assignment is waiting for him tonight. The form he showed latest makes him the most likely winner in the Sheffield Stadium Sprint, which is scheduled to get underway at 20:14 GMT. The 280 metres contest holds a winning prize of 200 pounds.

Bowtime Honcho is well drawn, but has a bit to find on the clock. The black dog was not impressive on his latest ride at Monmore, where he ended up fifth behind Goa Getta.

Fairly Handy ran poorly behind Lionhearted Andy last time. Although the fawn and white dog has recorded a good time of 16.04 seconds here in the past, nothing is going in his favour tonight.

Aulton Enda travelled well in the trials, but has plenty to prove at this level. Demesne Tornado has won his share around here. E. Parker?s trainee could enjoy an outside chance, if he gives his one hundred percent.

Lionhearted Andy is surely the second best hound in this pack - a major threat to Farloe Barracuda. The brindle dog travelled nicely on his previous two trips. He was beaten by Farloe Barracuda last time, and would require a special effort to dish out revenge. The silver medal is guaranteed, if not gold.

The Future of Marriage and the Wisdom of Tradition

As Sherif Girgis, Robert P. George, and I argue in The Wall Street Journal, the future of marriage is the future of humanity.

Conservatives rightly uphold the institution of marriage between a man and a woman because marriage is the seedbed of society, the necessary precondition for limited self-government.

But not everyone sees it this way. With the Supreme Court expected to decide this week whether to hear challenges to traditional marriage laws, now is the time for citizens to think deeply about the nature and purpose of marriage.

Marriage unites a man and woman holistically?emotionally and bodily, in acts of conjugal love and in the children such love brings forth?for the whole of life.

In the revisionist view of marriage, however, what sets marriage apart from other bonds is emotional intensity?what one philosopher refers to as your ?number one person.? But nothing about emotional union requires it to be permanent. Or limited to two. Or sexual, much less sexually exclusive. Or inherently oriented to family life and shaped by its demands.

As a result, redefining marriage to include same-sex relationships would harm the common good as it obscures the true nature of marriage and thus weakens the marriage culture. Weakening marital norms would hurt children and spouses, especially the poorest among us.

Empty appeals to ?equality? get us nowhere. As my co-authors and I argue:

The conjugal and revisionist views are two rival answers; neither is morally neutral. Each is supported by some religious and secular worldviews but rejected by others.? So voters must decide: Which view is right?

The best philosophy, theology, sociology, and what G. K. Chesterton called the democracy of the dead?tradition?all suggest that the conjugal view is right.

As we argue in our new book What Is Marriage? Man and Woman: A Defense, marriage is a uniquely comprehensive union. It involves a union of hearts and minds but also a bodily union made possible by sexual complementarity. Marriage is inherently extended and enriched by procreation and family life and objectively calls for similarly all-encompassing commitment, norms of permanence, and exclusivity.

Obama to appeal to public on 'fiscal cliff'

WASHINGTON (AP) ? President Barack Obama plans to make a public case this week for his strategy for dealing with the looming fiscal cliff, traveling to the Philadelphia suburbs Friday as he pressures Republicans to allow tax increases on the wealthy while extending tax cuts for families earning $250,000 or less.

The White House said Tuesday that the president intends to hold a series of events to build support for his approach to avoid across-the-board tax increases and steep spending cuts in defense and domestic programs. Obama will meet with small business owners at the White House on Tuesday and with middle-class families on Wednesday.

The president's visit to a small business in Hatfield, Pa., that makes parts for a construction toy company will cap a week of public outreach as the White House and congressional leaders negotiate a way to avoid the tax increases and spending cuts scheduled to take effect Jan. 1. The trip will mark Obama's first public event outside the nation's capital since winning re-election.

Both sides warn the so-called "fiscal cliff" could harm the nation's economic recovery, but an agreement still appears far from assured. The White House and congressional Republicans have differed on whether to raise revenue through higher tax rates or by closing tax loopholes and deductions.

House Speaker John Boehner, R-Ohio, has pushed for raising additional revenue through the reducing of tax loopholes instead of raising tax rates on wealthy Americans. The White House has countered that the president will not sign legislation that extends current tax rates to the top 2 percent of income earners, or those households with incomes over $250,000.

Obama, only weeks after winning re-election, has signaled his intention to rally the public to pressure Congress to support his agenda, an approach that helped him win passage of a payroll tax cut extension and prevented interest rates on millions of federal student loans from doubling last summer.

Obama campaign manager Jim Messina said in an email to supporters after the election that the president's volunteer base was crucial to his re-election but said it was not aimed "just to win a campaign. We have more progress to make, and there's only one way to do it: together."

Following the election, Obama aides asked supporters to record YouTube videos discussing the need to have the wealthiest Americans pay more in taxes. Some of the people who shared their stories on YouTube planned to join Obama at the White House on Wednesday.

On Friday, Obama will tour and deliver remarks at The Rodon Group manufacturing facility in Hatfield, Pa., offering the company up as an example of a business that depends on middle-class consumers during the holiday season. The company manufactures parts for K'NEX Brands, a construction toy company whose products include Tinkertoy, K'NEX Building Sets and Angry Birds Building Sets.

Congressional Republicans, led by Boehner, have expressed openness to discussing additional revenue but oppose any plan that raises tax rates on the wealthy. They argue that the higher rates would also hurt some small businesses and hinder economic growth.

Republicans have called for changes to the tax code to eliminate tax breaks and loopholes that primarily benefit the wealthy. Several key Republican lawmakers have also said they would not be bound by a no-tax-increase pledge that they have adhered to in the past.

Boehner and GOP leaders planned to meet Wednesday with members of a bipartisan coalition of former members of Congress and business leaders that has advocated cuts in spending in major health care programs as well as changes in the tax code to raise more money but also to lower rates.

ICE Shuts Down 2 SoCal Internet Businesses For Selling Fake Goods

LOS ANGELES (CBSLA.com) ? Two Southern California-based Internet businesses were among several shut down by U.S. Immigration and Customs Enforcement during a Cyber Monday crackdown on the online sales of counterfeit goods, officials announced Monday.

Special agents with Homeland Security Investigations in Ventura served seizure warrants for two domain names linked to www.autoforms8m.com.

The website claims to offer easy and affordable access to legal forms online and is suspected of selling counterfeit Adobe software, officials said.

?Preliminarily, federal investigators estimate the loss of revenue to Adobe at more than $3 million,? ICE agents said in a news release.

The second seizure involved the San Diego-based website, Staxxs on Deck, which sold counterfeit Nike footwear, officials said.

?In addition to selling counterfeit merchandise at its El Cajon storefront location, the company also operated a website ? www.23isking.com ? that offered knockoff Nike shoes online,? ICE said.

According to an affidavit, the company?s website made approximately $1.5 million in proceeds from the fake goods.

The annual crackdown, which began in 2010, resulted in the seizure of 132 domain names that sold fake goods.

Does any one here use them fancy cell phone thingy's?

I think I was the last one on this earth to own a computer. I just never saw a real "need" for one. However now I use it several hours a day and don't like being without it.

Cell phones have been the same for me. I think they are a real nice item to have however I have always considered them an expensive luxury item. Several years ago I came very close to being stranded out in the country side (out of gas). After that day I decided I could use a cell for emergency use. So I have owned a Tracfone (pay as you go) phone and it honestly has worked out quite well for me. I buy a one year plan for $99.00 and have never run out of minutes. So for about $8.00 a month I've had a cell phone for last 5 years or so.

Times are changing and I'm starting to think about getting one of those "smartphones". The thought of paying $150.00 or more every single month, is something that still bothers me but my wife says "$$$ I cant take it it with me $$$". So being the frugal person I am I want the most for my money without paying for something that I don't need. So I turn to you my friends to guide me. I'll trust you before I trust some salesperson trying to increase his sales commission. So I'm asking for opinions.

Let me tell you how I plan on using the phone. I actually do not make very many calls. Probably 300-500 or so minutes per year. However what I want to gain is the ability to recieve and send e-mail alerts on my new phone and text messaging. I also think I could use certain apps that are available. I want to be able to surf the web as well.

I think my wife and I have each decided to get "iphones". There are so many different variations of phones that makes it hard for a first timer to decide. Right now I'm trying to decide how much internal memory I will need. I wont store music, movies or games. I probably would store images on it.

iphones come in 8 GB,16 GB and 32GB. How much does the average person really need? I have asked two people with iphones in person. The first said he has never had more than the 8 GB version and the second told me that he has max out every phone he gets and now has the iphone 5 32 GB. How is a person suppose to decide these things?

US federal mediators to join NHL labor talks

WASHINGTON (AP) ? Federal mediators are entering the stalled NHL labor talks, with the season's first 2? months already lost because of the lockout.

George Cohen, director of the Federal Mediation and Conciliation Service, said Monday the parties had agreed to use the agency. He assigned three mediators to assist negotiations ? deputy director Scot Beckenbaugh, director of mediation services John Sweeney and Commissioner Guy Serota.

"While we have no particular level of expectation going into this process, we welcome a new approach in trying to reach a resolution of the ongoing labor dispute at the earliest possible date," NHL deputy commissioner Bill Daly said.

Cohen has worked with the players' associations for Major League Baseball, helping end the 1994-95 strike as an outside counsel, and the NBA. He was an adviser to the NHL players' union before joining FMCS three years ago.

"We look forward to their involvement as we continue working to reach an equitable agreement for both the players and the owners," said Donald Fehr, executive director of the NHL Players' Association.

Cohen mediated during the 2010 negotiations in Major League Soccer and 2011 talks in the NFL and NBA, along with this year's dispute between the NFL and its on-field officials.

Hockey players and management have not negotiated since last Wednesday. The NHL has canceled more than one-third of its regular season, including all games through Dec. 14, the New Year's Day outdoor Winter Classic and the All-Star weekend scheduled for Jan. 26-27 at Columbus, Ohio.

"I have had separate, informal discussions with the key representatives of the National Hockey League and the National Hockey League Players' Association during the course of their negotiations for a successor collective bargaining agreement," Cohen said in a statement.

"Due to the extreme sensitivity of these negotiations and consistent with the FMCS's longstanding practice, the agency will refrain from any public comment concerning the future schedule and/or the status of the negotiations until further notice."

Over the 5th and 6th of October 2012 1,064 members of the goo Research monitor group completed a private internet-based questionnaire. 58.2% of the sample were female, 10.5% in their teens, 13.7% in their twenties, 26.6% in their thirties, 27.6% in their forties, 11.7% in their fifties, and 9.9% aged sixty or older. Note that the score in the results refers to the relative number of votes for each option, not a percentage of the total sample.

Well I started a new on line business for my kid and decided that I would use this e commerce plugin for it due to all I had heard and seen. Wile it is pretty straight forward to setup and easy to use. I did find it missing some of the great features in WP ecommerce, I needed a couple of different options for shipping and payment that are not available without adding a plugin that cost a bit extra.

In fact as good as this plugin is most of the features that make it good are additional priced plugins

WP Advanced Include creates an [include] shortcode which can be used to add content from any Post or Page on your site including Post Content, Post Excerpt and Post Meta

Caution

The use of [include] to include itself with do_shortcode set to true will create an infinite loop, use wisely.

Marcus? Take: This is a wild plugin that has a lot of cool options for replicating content from one post to be embedded in another. The thing that I found really incredible was that I could use shortcodes of other programs and embed that to another page by using this WP Advanced Include shortcode. I used it for banners and testimonials to create a post mash-up for a client.

Jane Rowe, age 97, died November 17, 2012. She was born May 4, 1915, in Ludington, to William and Effie May (McAllister) Winey. She attended St. Simon Elementary School and graduated from Ludington High School, where she met her high school sweetheart on the tennis court.

Jane was a tennis champion her senior year and enjoyed all kinds of sports. She married her sweetheart, Clyde Rowe, on July 3, 1939. After a time away, Clyde, an Internal Revenue Agent, and Jane, an executive secretary for the Selective Service Administration, returned to Ludington, until the SSA closed the Ludington office in 1972, and Jane retired. Clyde and Jane spent their vacations touring the United States and Canada. After Clyde?s death in 1987, Jane took advantage of traveling around the world, including three trips to Europe and several cruises to the Caribbean, Mediterranean and the Panama Canal. Jane was a communicant member of St. Simon Catholic Church, a life member of Catholic Daughters, St. Simon Altar Society, a member of the Little Flower Circle, Pink Ladies, and a volunteer at the old hospital and at the new Memorial Medical Center in Ludington. She was a past president of the Hospital Auxiliary and a charter member of the Women?s Civic Club. Jane was also a member of the Women?s Literary Club, Emblem Club, the Ludington Bridge Club and was a member of Lincoln Hills Golf Club. She cherished spending 24 winters in Florida. Her hobbies included traveling, sports, reading and time spent with her family and friends. Jane was preceded in death by her husband, Clyde; her parents; a sister, Mildred Barber; brother-in-law, Lawrence Barber; a nephew, Thomas Swanson; and other family members.

FAMILY: Her son, Robert (Sonya) Rowe of Grand Rapids; granddaughters, Melissa Rowe and Michelle Rowe; great-grandchildren, Michael Tomko Jr., Tyler Rairigh, Alicia Rairigh, Dennis Rairigh III, Anthony Clark Jr., Mayson Clark and Bethany Clark; a nephew, Bill (June) Swanson.

MEMORIAL MASS: Tuesday, Nov. 27, 2012, at 11 a.m. at St. Simon Catholic Church, 702 E. Bryant Ave., Ludington, with the Rev. Fr. Thomas A. Schiller presiding.
